To use BarkSmart, you must:

  • Provide accurate information when creating an account or placing an order

  • Have the legal authority to enter into these Terms

3. Subscriptions and Orders

  • Subscription Plans: When you subscribe, you agree to recurring billing until you pause or cancel your plan.

  • Billing Cycle: Charges are processed automatically on the agreed schedule (e.g., weekly, fortnightly, or monthly).

  • Delivery: Meals are delivered to the shipping address provided. Delivery times may vary based on your location and courier services.

  • Account Responsibility: You are responsible for maintaining accurate account details, including payment and shipping information.

4. Pricing and Payments

  • All prices are listed in AUD and include applicable taxes unless stated otherwise.

  • We reserve the right to update pricing. Any changes will be communicated before your next billing cycle.

  • Payments are processed securely via third-party providers (e.g., Stripe). BarkSmart does not store your full payment details.

5. Cancellations, Pauses, and Refunds

  • Cancellations: You may cancel your subscription at any time through your account or by contacting us.

  • Pausing: You may pause your plan in line with our policy (e.g., before the next billing date).

  • Refunds: Due to the perishable nature of our meals, refunds are only offered if:

    • An order arrives damaged, spoiled, or incorrect, and

    • You notify us within 48 hours of delivery with proof (e.g., photos).

  • We do not offer refunds for late deliveries caused by couriers outside our control.

6. Customer Responsibilities

By using BarkSmart, you agree to:

  • Provide accurate information about your dog to ensure meals are safe and suitable

  • Store and handle meals according to our guidelines (e.g., refrigeration)

  • Use products responsibly and consult a veterinarian if your dog has health issues

7. Intellectual Property

All content on our website—including logos, text, graphics, product names, and images—is owned by BarkSmart and protected under copyright and trademark laws. You may not copy, distribute, or use our content without permission.

8. Limitation of Liability

  • BarkSmart provides general guidance on dog nutrition but does not replace veterinary advice.

  • We are not responsible for:

    • Adverse reactions if your dog has undisclosed allergies or conditions

    • Damages from misuse, storage errors, or failure to follow feeding instructions

    • Losses caused by third-party delivery providers

  • To the fullest extent permitted by law, BarkSmart’s total liability will not exceed the amount paid for your most recent order.

9. Indemnification

You agree to indemnify and hold BarkSmart harmless from claims, damages, or expenses arising from your misuse of our Services or violation of these Terms.
